Contest Rules
1) The photograph should be centered around or landscape, not people.
2) You must have taken the photograph. Do not submit a photograph owned by someone else.
3) Only one submission per person is allowed.
4) Digital enhancement is allowed if it does not change the character of the photo. This will ultimately be at the discretion of Tours4Fun.
5) Photographs may not have won any other award or have been previously published.
6) You must be 18 years of age or older to submit a photograph or win the contest.
7) You do NOT have to reside in the U.S. to win. More than half of our customers live outside of the United States.
Photograph Submission
All photos must be approved before being entered into the contest and can be rejected for any reason or for no reason whatsoever. Tours4Fun is
a family-friendly site, we reserve the right to reject unsuitable or pornographic images, or photographs that are unrelated
to the theme of the contest.
Entrant must have personally taken the photograph submitted and possess all ownership and distribution rights to the
picture. Entrant must be the sole owner of the copyright of any image submitted. Submission of a photo and entry form is
your guarantee that you are the owner and copyright holder of the photo. We reserve the right to revoke the winning
status of any photograph which does not meet these requirements.
Should Tours4Fun receive a copyright infringement complaint or lawsuit, the person who submitted the offending
photograph will be solely responsible to resolve the complaint or lawsuit. Tours4Fun is excluded from any attorney fees
or involvement in such a complaint or lawsuit.
Tours4Fun reserves the right to reject or remove any photograph that
has been altered in anyway from the original shooting. Photographs may not have won any other award or have been
previously published.
All relevant dates and deadlines will be posted on the entry pages. Tours4Fun reserves the right to alter any of these dates
at any time, for any reason, and/or suspend the contest indefinitely or terminate it altogether without choosing a winner
for any reason whatsoever.
Judging
Tours4Fun has implemented a voting system whereby third-party visitors to the website are able to vote for submitted
photographs based on their preference. Tours4Fun retains the right to select the final winner if there is malfunction or
abuse of this system, or for any other reason that may necessitate a manual selection. If such a need arises, the winner
will still be selected on merit and without purposeful bias. No one working for, affiliated with or related to someone
working for Tours4Fun will be eligible to win the contest.
At the conclusion of the entry period, Tours4Fun will select the winner from all eligible entries received during each entry
period, based on the third-party voting system, assuming no manipulation or error with the system, or for any other reason
that Tours4Fun deems necessary to ignore the ranking system. The chosen winner will be contacted via email and will be
asked to provide his or her full name, age and mailing address within a specified time period. If a potential winner does not
respond within the timeframe stated in the notification email, Tours4Fun may select the second best photo from all entries
received during the entry period.
Tours4Fun may require proof that the photograph was in fact taken by and the sole property of the entrant, and may
choose to reject the winning photograph at any time and for any reason.
Usage of Photographs
Entrant retains all rights of ownership to submitted photographs, but Tours4Fun reserves the right to use all submitted
photos for marketing, promotion, distribution or any other purpose, throughout any web properties affiliated with
Tours4Fun, whether or not they derive profit or non-monetary gain, intentionally or otherwise.
Privacy
Participants must submit your email address to enter the contest and submit a photo. Your email address will not be sold, rented
or revealed to any third-party, however your email address will be added to the Tours4Fun customer database. By
submitting your photo you agree that we may contact you via email regarding promotions, company announcements or
any other marketing purposes.
Prize
The winner will be given a choice of prizes selected by Tours4Fun as indicated on the contest entry page. Prizes
may change at any time, for any reason, without notice or recourse. The winner will earn the right to choose from the
available selection presented and participate without paying the retail price listed on the website. The
winner may choose one (1) quest to partake in the tour for free.
Tours4Fun reserves the right to honor the discount on a different prize or for different dates if necessary. Flexibility or
alteration of the prize is at the sole discretion of Tours4Fun.
All expenses for travel or those incurred that fall outside of the parameters of the prize awarded will be the
sole responsibility of the travelers. In no way shall Tours4Fun be responsible for any additional expenses not covered by the
prize, loss or damage, or any other harm that may come from participation on any tour awarded. Purchasing Travel Insurance is the
sole responsibility of the travelers.
Winner
Winning the contest is subject to these conditions, and is at the sole discretion of Tours4Fun. Participation in the contest
or submission of a photograph to Tours4Fun constitutes a complete and unconditional acceptance that you have read,
understood, agree to and will comply with all of the aforementioned terms and conditions.
Release and Limitations of Liability
By participating in the Contest, entrants agree to release and hold Tours4Fun harmless from and against any claim or cause
of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to:
(a) unauthorized human intervention in the Contest;
(b) technical errors related to computers, servers, providers, or telephone or network lines;
(c) printing errors;
(d) lost, late, postage-due, misdirected, or undeliverable mail;
(e) errors in the administration of the Contest or the processing of entries; or
(f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from
entrant's participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action,
Tours4Fun’s liability will be limited to the cost of entering and participating in the Contest, and in no event shall
Tours4Fun be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not
limited to, punitive, consequential, direct, or indirect damages.
Disputes
Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected
with, the Contest or any prize awarded shall be resolved exclusively in an appropriate court located in California. All issues
and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant's rights
and obligations, or the rights and obligations of Tours4Fun in connection with the Contest, shall be governed by, and
construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules
(whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than
the state of California where Tours4Fun is incorporated.
Contest Results
To request the name(s) of the winners, send a self-addressed stamped envelope stating the name of the particular contest to
24 West Saint Joseph St, Arcadia, CA 91007.
Requests must be received within thirty (30) days from the end date of the applicable Contest.
